A trade mark can be a letter, number, word, phrase, logo, picture etc.aspect of packaging or any combination of these. It is used to distinguish goods and services of one trade from those of another. This means you can't register a trade mark that directly describes your goods (e.g. radios) and services (e.g. electrician).

Unfortunately most people believe when they register a company or business name, they own that name. The fact is, without a trademark your business is at risk and all your had work may benefit a competitor. If someone else has a trademark similar to your business name, they can make you change it or effectively stop you from doing business.

Our costs are consumer friendly. To complete a trademark search and lodgement of your trademark within Australia is $495. This includes Government Filing Fee and GST per class. There are 45 classes of goods and services. Each class includes a wide range of products within that class.

STEP 1 SEARCH
It is important before applying for a trademark for The Licensing Connection to conduct a search of all trademarks currently in place to ensure your requested trademark has not already been registered in your designated class.

STEP 2 APPLY
The Licensing Connection will file your trademark application in your name to the Trade Marks Office. After examination by the Trade Marks Office to ensure there are no similar trademarks, your trademark is not generic or descriptive, a letter advising approval of your trademark is sent to you. If there are any problems, The Licensing Connection will communicate on your behalf with the Trade Marks Office.

It is important to note that all applications are completed in your name to ensure you have control over your business and do not get charged expensive on-going administration fees.

The Licensing Connection will obtain approval of your trademark from the Trade Marks Office in approximately 7 - 10 working days, at which time you are permitted to use the symbol TM.

STEP 3 TRADEMARK REGISTRATION
Over the next 6 months your trademark is advertised in the official Trade Marks Journal to allow third parties the opportunity to oppose it. After this time if there are no objections, a registration fee of approx. $250 is payable to the Trade Marks Office and you will to receive your CERTIFICATE OF REGISTRATION. Once again, this is the actual cost and includes no administration fee. You are now entitled to use the mark (R) after your trademark on all products and documentation.

This registration fee secures your trademark for a period of 10 years. You are now safe in the knowledge your brand and business assets are protected indefinitely with a small renewal fee payable every 10 years.
